AFFILIATE PROGRAM TERMS & CONDITIONS

Terms & Conditions

For clarity purposes, the terms "we", "our", "us" refer to 33 DRUGS LTD; terms "affiliate" and "you" mean the other party to the contract formed by your acceptance of these Terms and Conditions; Your participation in the promotion of our services and products is referred as "DRUGREVENUE Affiliate Program" or "Affiliate Program".

Preamble

33 DRUGS LTD is not licensed to practice medicine; it only connects customers to licensed pharmacies and physicians by providing a web site order platform and back office system. Affiliate is an independent contractor seeking registration for the DRUGREVENUE Affiliate Program.

Terms of the agreement

The terms of this agreement will begin upon creating of the Affiliate's account in the program and will end when terminated by either party. Either Affiliate or 33 DRUGS LTD may end this agreement any time with or without a cause. When decision to terminate this agreement has been made, a written notice to the other party should be sent by email.
The relationship in this agreement is non-exclusive for both parties. The Affiliate will be entitled to provide links to sites of other companies through their own site. Any web sites, banners, links, text and html that you obtained through your affiliate relationship with us should be used only for promoting our affiliate program; likewise we shall be permitted to contract with other affiliates.
SPAM in any form, used in connection to our Affiliate program is forbidden. Violation of this term will lead to immediate termination of your affiliate account and all commissions will be forfeit. Therefore, you agree not to engage in any form of SPAM to market our DRUGREVENUE Affiliate Program.
You agree not to broker a web site, or template without the written permission of 33 DRUGS LTD, as this will be defined as reselling a web site or web site template linked to the DRUGREVENUE Affiliate Program for a monetary or other consideration where such sales or provision forms a part of the ordinary course of your business.
33 DRUGS LTD retains all rights, including Copyright, over all Promotional tools transferred to you as part of your participation in the DRUGREVENUE Affiliate Program; therefore you agree that should your participation in the DRUGREVENUE Affiliate Program be terminated you agree to destroy all such material.
You agree that you will not knowingly benefit from known or suspected traffic not generated using accepted marketing practices, this obligation remains regardless whether or not it causes 33 DRUGS LTD or the Affiliate Program harm. You agree that should fraudulent activity arise, which includes false traffic, or clicks, and false or fraudulent sales; we have the right to refuse payment of commission in such circumstances, and/or to retract any commission already paid. In no event shall we be responsible for any indirect, incidental, consequential, special or exemplary damages, including without limitation, loss of profits or loss of business opportunity, even if such damages are foreseeable and whether or not we had been advised of the possibility thereof. Our maximum aggregate responsibility shall not exceed the total outstanding commission fees payable to you under this Agreement.
You agree to keep in confidence all materials connected to the DRUGREVENUE Affiliate Program, this includes your commission payments, the working practices of, and documents relating to, the operation of this Affiliate Program, as well as the operations of 33 DRUGS LTD. This Clause survives termination, completion, expiry or repudiation of this Agreement. If you fail to follow these rules we may cancel your Affiliate account and your balance may be forfeited.

Commission Payments

Your commission is paid every fortnight. All the payments are in US dollars. The minimal payable amount is $100 by WebMoney and Fethard and $1000 if you choose wire transfer. You agree that it is your responsibility to maintain in our back office system accurate and up to date records of your banking and/or payment information.
We reserve the right to change the commission rates at any time without prior notice. 33 DRUGS LTD may modify any of the terms and conditions contained in this agreement at any time and in 33 DRUGS LTD own discretion. Modifications may include changes in the referral fees, referral fee payment schedules, payment procedures and program rules.

Modification of the Agreement

If you do not agree with some of modifications the only way out is to terminate this agreement. If the affiliate continues participation in the DRUGREVENUE Affiliate Program after 33 DRUGS LTD posted a notice about changes in the terms or a new agreement on 33 DRUGS LTD website, this will mean that you accept modified agreement.
